MINUTES

Trustees Present: Len Gensburg, Jeffrey Freiberg, Monib Khademi, Paula Reynolds

1. CALL TO ORDER The Mill Valley School District Board of Trustees, acting as the Governing Board of the Mill Valley School District, met in special session at 4:15 PM on Friday, May 9, 2003 at the Mill Valley School District Administrative Office, 411 Sycamore Avenue, Mill Valley, CA.   President Khademi called the meeting to order at 4:15 PM and announced that Mr. Swartz was absent due to a prior commitment.
2. CLOSED SESSION
A. Public Comment
There was no public comment.
B.1. Recess - Closed session; labor negotiations Mr. Khademi recessed the meeting to Closed Session at 4:15 PM for Conference with Legal Counsel - Anticipated Litigation (Gov. Code §54956.9 (b)); Significant exposure to litigation: one case.
3. RECONVENE & REPORT Mr. Khademi reconvened the meeting at 4:28 PM and reported that no action was taken.
4. BUILDINGS & SITES - MS floor covering Superintendent Young reviewed the current health and safety concerns of current carpeting at Middle School.  In order to do the work this summer, the replacement flooring needs to be ordered as soon as possible.  Ms. Young reviewed the costs, including removal and disposal of old carpeting and the installation of the new product, which has a 20 year guarantee.  These costs of $298,836 can be funded from the Modernization Fund.  The purchase will be processed through CMAS (California Multiple Awards Schedule), which ensures that public entities will receive the best competitive price. Additional funds will be needed for any moving costs necessary and corrective work on the stairwells in order to make them DSA compliant.   Ms. Harden reviewed the current facilities funds and the implications of using each.  
- Motion: approve purchase M/S/C Freiberg/Gensburg (4-0) to approve the purchase to replace the Middle School carpeting for $298,836 using modernization funds.
5. ADJOURNMENT Mr. Khademi announced that the next regular Board meeting will be at 7:00 PM on Monday, May 19, 2003 at the Mill Valley School District Administrative Office and adjourned the meeting at 4:50 PM.
